Who this is for

Kerby is sold to approved driving instructors and trainee instructors for use in their business. It is not a consumer service, and you are agreeing to this as a business rather than as a consumer.

You need to be entitled to teach people to drive for money in Great Britain. We do not check that, and it is your responsibility rather than ours.

What Kerby is, and what it is not

Kerby is a diary, a pupil record, a driver’s record and a set of books. It is a tool you use to run your business.

Kerby does not find you pupils, does not take bookings on your behalf, and is not a marketplace. Nobody is introduced to you by us. Any arrangement you have with a pupil is between you and them, and we are not part of it.

Kerby is not your accountant. The figures it shows are arithmetic on what you entered. What you owe HMRC is between you and them.

What it costs

£14.99 a month. The first hundred instructors pay £6.99 a month, and that rate is held for as long as the account stays open — it is not an introductory price and it does not step up after a year.

There is no commission. Not on a lesson, not on a block, not on anything a pupil pays you. When a pupil pays by card through Kerby, the money goes to your own payment account and we never hold it.

Text reminders are an add-on at £5 a month, which includes 100 message parts. Parts beyond that are 5p each. A text is one part, or two if it contains an accented character — that is how the mobile networks count them, not a choice we made.

Prices exclude VAT where it applies. If we change what you pay, we will give you at least 30 days’ notice by email with the reasons, and you can cancel before it takes effect.

Payment

Monthly in advance, by card, through Stripe. Card details go to Stripe and are never held by us.

If a payment fails we will keep trying for a short grace period and tell you. After that, writing in your diary is suspended — but you keep read access to your records, and lessons already booked stay in the diary. A billing problem between you and us is not a pupil’s problem.

Your records are yours

Your pupils, your lessons, your notes and your figures belong to you. We claim no ownership of them and will not sell them, publish them or use them to build anything else.

You can export everything Kerby holds, as a file, at any time, from inside the product and without asking us. If you leave, that is how you take it with you.

You are responsible for what you put in — in particular, for having a lawful basis to hold your pupils’ details, and for what you write in a lesson note. The privacy policy explains how that works.

Using it sensibly

  • Keep your password to yourself; the account is yours to look after.
  • Do not use Kerby to send anybody messages they have not agreed to receive.
  • Do not try to reach another instructor’s data, or to get around the limits of your account.
  • Do not resell Kerby or run somebody else’s driving school from one account.

Ending it

You can cancel at any time, from inside the product. Your subscription runs to the end of the month you have paid for, and we do not refund part of a month. You can close the account entirely, which removes your details and your pupils’ details — see the privacy policy for what we have to keep.

We can end it too, with 30 days’ notice. We can suspend an account immediately without notice if it is being used to break the law or to put somebody at risk, and we will tell you why and give you a way to respond.

Availability

We will keep Kerby running as well as we reasonably can, and we do not promise it will never be unavailable. There is no uptime guarantee on these terms.

Reminders are sent through third parties and delivery is not something anybody can guarantee. Treat a reminder as a help rather than as proof a pupil was told.

If something goes wrong

Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow to be limited.

Otherwise, and because this is a business-to-business service: we are not liable for lost profit, lost business, lost bookings or loss of goodwill, and our total liability in any twelve-month period is limited to what you paid us in that period.

Keeping your own records is your responsibility. The export exists so that is straightforward.

Changes to these terms

If we change anything that affects what you are agreeing to, we will email you at least 30 days beforehand and say why. Carrying on using Kerby after that is how you accept the change; cancelling before it takes effect is how you do not.

Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
